1. Definitions
Platform: D-Talk website and services. Creators: artists & fashion designers who upload content. Brands: companies or individuals who purchase and customize designs. Content: artwork, sketches, 3D designs, descriptions, and related assets.
2. Account & eligibility
You must be at least 18 years old and provide accurate information to create an account.
- Each user is responsible for maintaining the confidentiality of account credentials.
3. Uploads, content & approvals
Creators may upload Content for sale. All uploads must comply with our content rules. Uploaded Content is submitted for administrative review. Approval is required before the item is listed for brands to purchase.
4. Ownership & licenses
Creators retain ownership of their Content. By uploading, creators grant D-Talk a limited, non-exclusive license to display, preview, and enable commercial use of the Content on the platform and for order fulfillment. When a brand purchases a license to use Content on apparel, the license terms (duration, scope, exclusivity) are set at the time of sale.
5. Sales, commissions & payouts
- When a brand purchases a creator's design, D-Talk handles the transaction, production, and delivery.
- D-Talk retains a platform commission (disclosed at checkout). The remaining proceeds are credited to the creator's account.
- Earnings are held until payout conditions are met (withdrawal threshold). Creators may request withdrawal to their bank after meeting the threshold and providing required payment info.
6. Payments, samples & production
Orders typically follow a sample-then-bulk flow. Brands pay a partial sample fee (e.g., 50%) at order creation. After the sample is produced and approved by the brand, the remaining balance is paid and bulk production begins. D-Talk manages production and delivery. Refunds, returns, and quality issues are handled per our order policies.
7. Platform mediation & no direct contact
To protect creators and brands, the platform mediates commercial interactions. Users do not exchange direct contact details for order negotiations outside the platform. All transactions, approvals, and communications related to orders should remain on-platform.
8. Prohibited content & conduct
Users must not upload or transact in illegal, infringing, hateful, pornographic, or otherwise prohibited content. D-Talk may remove content or suspend accounts that violate rules.
9. Warranties & disclaimers
Users represent they have rights to the Content they upload. D-Talk provides the platform "as is" and disclaims implied warranties to the extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, D-Talk will not be liable for indirect, incidental, or special damages arising from platform use, except where prohibited by applicable law.
11. Termination
D-Talk may suspend or terminate accounts for violations. Termination does not relieve users of outstanding obligations (e.g., completed orders, fees owed).
12. Dispute resolution
We encourage users to resolve disputes through the platform's support channels. These Terms are governed by the laws of the jurisdiction listed in our contact footer (or as set in local policies).
